Well, we have been flooded with positive responses to emails sent last night to current and former clients. You and Carlos have many loyal fans, people just like us who felt they were making a leap of faith and were then delighted with having done so.

All depends now on getting our line of credit finalized, and we are frustrated by the slowness of the process. Peter will persist again this morning. There is no reason for denial, but it is SLOW. Once we came up with the idea of renting Diagonal for a short time until we could downsize here, things began to look feasible. In the meantime, we have started to learn some Spanish at home and will enroll in a class in May. Our goals are clear. Now . . . to make them a reality!

We visited Bucerias in January. 2007. It was our first time in the Vallarta area and had absolutely no intention of buying anything. We we're simply on vacation.

But while jogging on the beach I saw different buildings going up and visited a few for fun. Then I saw Cindy with an openhouse sign in front of her building. I went back the next day with my girlfriend and, after visiting Cindy's appartment I decided to meet Carlos. Cindy set up the appointment for the day before we were leaving as Carlos was out of town.

When I met him I was quite impressed. He seemed very straightforward, lowkey and intelligent. But what made me decide to buy was the fact that he seemed so proud of his buildings and his desire to improve with every project. My girlfriend almost fell off her chair. She thought I was a little crazy.

So did I when I got home and sent a check for more than 1/3 of the price to Carlos' personal bank account in Texas. But I found out that's the way things are done in Mexico. I was very nervous when construction didn't start on time but Cindy explained the reasons.

Speaking of Cindy, I must say that I didn't know if she was telling me the truth when she said she would stay in touch well after the signing of the contract. But the fact is she's done much, much more...she's been holding our hands for the past year, keeping us abreast of the advances in construction, acting as an intermediary with Carlos (he hardly ever answers emails) and much more.

As a matter of fact, we're here in Bucerias now and should be taking possession of our condo a couple of weeks ahead of schedule (the 2 month grace period). Also , to try to thank Cindy and her husband Jeff, we've asked them to join us for dinner tomorrow evening.

As far as the building goes, Punta Arena is much better than we expected. Carlos added things that were not in the plans...a bigger and more beautiful pool area, a gym downstairs and large pantry in the kitchen are certainly wonderful additions...and he's not asking a penny more. I judged him correctly, he IS a proud man.

I certainly wouldn't want to tell you what you should do but I can say that I am extremely happy that I decided to buy here.

We were up on our balcony this afternoon and the view is AMAZING. Funny, but my girlfriend didn't think I was so crazy anymore!
And the icing on the cake is that I could probably sell right now for a 20 to 30 percent profit. But it's not for sale.

Q: Can a foreign citizen own real estate in Mexico?

Answer:

Yes, by placing the property in a bank trust. Bank Trusts are called Fideicomiso in Mexico.

Q: Can I own property near or in front of the ocean?

Answer:

Yes, laws passed in 1973 and 1993 have made it possible for foreigners firms, and Mexican firms with foreign participation to acquire interests in coastal real estate through a bank trust.

Q: Who is involved in a bank trust?

Answer:

Three parties. The seller of the property is the trustor, the bank is the trustee (fiduciario), the buyer is the Beneficiary (fideicomiso).

Q: How much does the bank trust cost?

Answer

Based on the current tariff, the bank charges the person desiring the fideicomisoan initial fee of approximately $500 USD for drawing up the agreement and establishing the Trust plus a percentage based on the value of the property.

Q: Are there additional fees for the bank trust?

Answer:

Yes, the bank charges an annual fee to covers its services as a trustee. This fee is based on the value of the property.

Q: How does the trust function?

Answer:

Title of the property is transferred to a trust with a Mexican bank acting as trustee. The Trust Agreement is formalized by the issuance of a permit from the Mexican Ministry of Foreign Affairs. The lot or home buyer is designated as Beneficiary in the Trust and the beneficiary rights are recorded in the public record by a Notary Public,

Q: What are my rights as a buyer?

Answer:

The Trust is a legal substitute for fee simple ownership, but I many cases, the Trustee is the legal holder of the property. As Beneficiary, you have the right to sell your property without restriction. You may also transfer your rights to third or pass it on to named heirs.

Q: Is the Trust renewable?

Answer

Yes, according to the Foreign Investment Law passed in 1993, trusts can be renewed for a indefinite number of successive 50 years periods. In effect they run in perpetuity.

Q: Who is involved in Real Estate transactions in Mexico?

Answer:

Normally there are four players involved in a real estate transaction. These are the real estate company, the buyer, a bank and a Public Notary.

Q: What role does a Public Notary play?

Answer:

A public Notary is a government-appointed lawyer who processes and certifies all real state transactions including drawing up and reviewing all official documents to ensure the proper transfer of the property

Q: What are these official documents?

Answer

The official documents which are required by law in order to transfer the ownership of the property in Mexico include a non-lien certificate based on a complete title search from the public Property Registry, a statement from the municipality regarding property assessments, water bills, and other pertinent taxes that might be due, and an appraisal of the property for tax purposes.

Q: If at a later date I decide to sell my property, can anyone buy it?

Answer:

Yes, if the buyer is also a foreigner, you simply assign beneficial rights. If the new buyer is a Mexican National, you can instruct the bank to endorse the title in a favor the buyer.
